- Agreement to terms
1.1. By making a booking and completing the pre-booking confirmation form, the guest agrees to be bound by these Terms and Conditions, which create a legally binding agreement between the guest and the host.
1.2. These Terms and Conditions apply to all bookings, regardless of whether the booking is made directly with the host or via third-party platforms such as Airbnb, Booking.com, or others.
1.3. It is the sole responsibility of the guest to read, understand, and accept these terms before completing the booking process and filling out the pre-booking confirmation form. - Payment Terms
2.1. Bookings will only be considered confirmed upon receipt of the required payment, either full or deposit, as specified in the Booking and Cancellation Policy.
2.2. Payments can be made via electronic funds transfer (EFT), credit card payments, or third-party booking platforms where applicable.
2.3. Upon successful completion of payment, a confirmation receipt will be issued and sent to the guest, which should be retained as proof of booking.
2.4. In the event that the full payment is not received by the specified deadline, the host reserves the right to cancel the booking without notice, and any deposits may be forfeited. - Guest Responsibilities
3.1. The guest must clearly communicate any specific requirements, such as additional bathrooms, accessibility needs, or room preferences, at the time of booking.
3.2. Guests are responsible for treating the property with care and ensuring it is left in the same condition as found at check-in.
3.3. Any damage, loss, or alteration to the property or its contents caused by the guest during their stay will be financially the responsibility of the guest. The host reserves the right to charge for repairs, replacements, or any necessary cleaning.
3.4. The guest is responsible for ensuring that all guests within their party abide by the Terms and Conditions and any applicable house rules during their stay.
3.5. The guest is required to notify the host immediately of any property-related issues or damage that occurs during the stay. - Check-In and Check-Out
4.1. The standard check-in time is from 2:00 PM onwards.
4.2. The standard check-out time is by 10:00 AM.
4.3. Late check-outs or early check-ins are subject to prior approval by the host and may incur additional charges. Requests for early check-in or late check-out must be made at least 48 hours in advance, subject to availability.
4.4. Any guest failing to check out by the specified time may be charged a late check-out fee, in addition to any other applicable charges. - Privacy and Safety
5.1. The host will handle all personal information provided by the guest in compliance with the Protection of Personal Information Act (POPIA) to ensure privacy, confidentiality, and data security.
5.2. The guest agrees to comply with all building safety regulations and guidelines set by the host, including fire safety procedures, emergency exits, and any other safety instructions provided at the property.
5.3. The guest should take reasonable precautions to ensure personal safety and security while on the property, including locking doors and windows when leaving the property. - Refund Processing
6.1. Refunds for cancellations made during peak periods, as defined in the Booking and Cancellation Policy, will only apply if the canceled dates are successfully rebooked. Refunds will be limited to 50% of the rebooked amount, less a 10% administrative fee.
6.2. All refunds will be processed within 21 business days from the date of cancellation, subject to compliance with these Terms and Conditions.
6.3. Refunds will not be issued for bookings canceled within 7 days of the check-in date unless under special circumstances (as defined in the Booking and Cancellation Policy). - Force Majeure
7.1. The host shall not be held liable for any cancellations, delays, or changes to bookings caused by unforeseen circumstances, including, but not limited to, power outages, extreme weather, natural disasters, pandemics, government-imposed restrictions, or other events beyond the host’s control.
7.2. In such cases, the host will make reasonable efforts to offer alternative accommodations or reschedule bookings, but no financial compensation or refunds will be provided beyond the options presented. - Non-Transferable Bookings
8.1. Bookings are non-transferable. If a guest wishes to transfer the booking to another individual, prior written consent must be obtained from the host. Failure to obtain consent may result in the cancellation of the booking.
8.2. The guest may request a change of dates or name, subject to availability and approval by the host, with any associated fees clearly outlined before confirmation. - Legal Compliance
9.1. These Terms and Conditions comply with the Consumer Protection Act (CPA) and any applicable South African laws and regulations.
9.2. Any non-refundable clauses are enforceable under the CPA when they are clearly disclosed to the guest at the time of booking.
9.3. The host reserves the right to update or modify these Terms and Conditions at any time without notice, and such modifications will apply to all future bookings made. - Complaints and Disputes
10.1. Any complaints regarding the property, stay, or service must be submitted in writing to the host within 7 days of check-out.
10.2. The host will review and respond to all complaints within 14 business days, aiming to resolve any issues in a fair and timely manner.
10.3. In the event of a dispute that cannot be resolved amicably, the guest agrees to seek resolution through an alternative dispute resolution (ADR) process or submit the dispute to a local jurisdiction for legal action, if necessary.
Booking and Cancellation Policy
Special Circumstances
8.1. In the event of emergency cancellations due to illness, death, or similar, the host may request documentation and will review the case on a case-by-case basis. Refunds in these situations will be at the host’s discretion.
Booking Confirmation
1.1. A booking is considered confirmed once the required payment, whether full or deposit, has been received, as specified in the Payment Terms.
1.2. Guests should ensure that all necessary details are provided at the time of booking to avoid delays or errors in confirming the reservation. Special requests, including additional rooms, accessibility needs, and specific preferences, should be communicated at the time of booking.
Peak Period (December 15 – January 5)
2.1. Payment: Full payment is required to confirm the booking during the peak period.
2.2. Conditions: All bookings made during this period are strictly non-refundable, regardless of cancellation time.
2.3. Booking Confirmation: Full payment must be received before the booking is confirmed for this period.
2.4. Refunds: If the canceled dates are rebooked, the guest will be refunded 50% of the rebooked amount, less a 10% administrative fee. If the dates are not rebooked, no refund will be issued.
Off-Peak Period
3.1. Deposit: A 50% deposit is required at the time of booking.
3.2. Balance Payment: The remaining balance must be paid no later than 7 days prior to check-in.
3.3. Failure to Pay: If the balance is not paid by the due date, the host reserves the right to cancel the booking without refunding the deposit.
Cancellation Policy
4.1. Peak Period (December 15 – January 5):
- Non-Refundable: All bookings during the peak period are strictly non-refundable.
- Resold Dates: If canceled dates are successfully rebooked, the guest will be refunded 50% of the rebooked amount, minus a 10% administrative fee.
- Unbooked Dates: Any dates that remain unsold will not be refunded.
4.2.Off-Peak Period:
More than 14 days before check-in: Full refund of the deposit, minus a 10% administrative fee.
7-14 days before check-in: 50% refund of the total booking amount.
Less than 7 days before check-in: No refund will be issued for cancellations made within 7 days of the check-in date.
Changes to Bookings
5.1. Peak Period: No changes to bookings are allowed during the peak period.
5.2. Off-Peak Period: Changes to bookings must be requested at least 7 days before the scheduled check-in date. All changes are subject to availability and may incur additional charges.
No-Show Policy
6.1. If a guest fails to check in on the scheduled date without prior notice, the booking will be classified as a no-show. All payments made will be forfeited, and no refund will be issued.
Early Departures
7.1. Guests who depart earlier than the booked check-out date will not be entitled to any refund for the remaining days of their stay.
